TERMS & CONDITIONS OF SALE
1. Buyer’s Premium
A 10% Buyer’s Premium will be added to the final bid price of each lot. All bids are final.
2. As-Is / Where-Is Sale
All items are sold AS IS, WHERE IS, with all faults and defects, whether known or unknown. Neither the Auctioneer nor the Seller makes any warranties or guarantees, express or implied, including but not limited to merchantability or fitness for a particular purpose. Descriptions are believed to be accurate but are not guaranteed.
Inspection prior to bidding is strongly recommended and available.
3. Payment Terms
Full settlement is due on the day of the auction or the following business day, unless otherwise stated in writing.
Accepted forms of payment:
- Cash
- Cashier’s Check or Money Order
- Wire Transfer
- Personal or Business Check with bank letter of guarantee
- Credit Cards: Visa, MasterCard, American Express, Discover (4% convenience fee applies)
International Buyers:
- International credit cards are not accepted
- Payment must be made via wire transfer in U.S. funds
- A $50 international wire transfer fee applies
Non-Payment:
- Any invoice not paid within five (5) banking days from sale day may be:
- Charged in full to the credit card on file (including 4% fee), and/or
- Subject to interest at 2% per month, prorated daily beginning on sale day
Do not rely on financing. Buyers are legally responsible for payment regardless of financing approval.
4. Automatic Credit Card Charges
If payment arrangements are not made by the close of the scheduled load-out period, the credit card on file will be charged automatically for any outstanding balance, including the 4% credit card convenience fee.
5. Sales Tax
Sales tax will be added to all taxable items and is calculated on the final bid amount plus buyer’s premium, where applicable.
Tax-exempt buyers must submit a valid exemption certificate prior to payment.

6. Vessel Removal & Load-Out
Buyers are responsible for all disassembly, loading, removal, transportation, freight, handling, and related costs.
Vessel removal timeframes must be coordinated in advance.

Failure to remove items within the designated timeframe may result in storage fees, forfeiture, or resale at the Auctioneer’s discretion.
7. Risk, Liability & Site Access
All persons entering auction sites do so at their own risk. Henderson Auctions is not responsible for injuries, accidents, or property damage occurring on auction premises.
8. Bidding Authority & Auctioneer Discretion
The Auctioneer and Bid Caller have sole and absolute discretion to:
- Determine the winning bidder
- Open, close, reopen, or extend bidding
- Resolve tie bids
- Reject or exclude bidders
- Correct clerical or bidding errors
Only the Auctioneer’s invoice constitutes official notice of sale. Notifications from online bidding platforms are not official.
The auctioneer may bid on behalf of the seller in an auction with reserve if the right to bid is expressly reserved by or on behalf of the seller.
9. Online & Live Bidding Disclaimer
Henderson Auctions is not responsible for:
- Online platform clerking errors
- Displayed prices that differ from the Auctioneer’s final call
- Platform-generated emails or invoices
Official invoices are issued only by Henderson Auctions.
10. Photographs & Listings
Photographs are provided for reference only. Items shown may not be included unless specifically stated. Buyers must rely on lot descriptions, not photographs.
11. Default & Remedies
Failure to pay or comply with these terms may result in:
- Forfeiture of deposits
- Automatic credit card charges
- Legal action
- Suspension from future auctions
12. Governing Law & Venue
All disputes, claims, or litigation arising from this auction shall be filed exclusively in Livingston Parish, Louisiana, and governed by the laws of the State of Louisiana.
13. Bill of Sale
Buyer is responsible for providing a Bill of Sale upon completion of the transaction.
It is the buyer’s obligation to ensure all necessary documentation is properly prepared, executed, and submitted to facilitate the transfer of ownership.
