ONLINE AUCTION TERMS & CONDITIONS PLEASE READ CAREFULLY. By registering for or participating in this auction, bidders acknowledge that they have read, understand, and agree to be bound by these Terms & Conditions. All bids are subject to these terms, which may only be modified in writing by Montrie Auction & Estate Service, LLC. If you do not agree to these Terms & Conditions in their entirety, do not register or place a bid. USA BIDDERS ONLY: Participation in this auction is restricted to bidders residing within the United States.. International bidders are not permitted to register or bid. All vehicles are available for local pickup only. No shipping is offered. BUYERS PREMIUM: A 10% buyer's premium will be added to the winning bid of each vehicle. For example, a winning bid of $10,000.00 will result in a total purchase price of $11,000.00, excluding any applicable taxes, title fees, or registration fees. REGISTRATION: You must be at least 18 years old to register and participate in the sale. In order to bid, you must create a username and password. You agree that all information provided during registration is true, accurate and up to date. AUCTION FORMAT: This is an online-only auction. Bids may be placed online during the designated bidding period. Lots will close at staggered times. If a bid is placed within one (1) minute of a lot's scheduled closing time, the bidding period for that lot will automatically extend by an additional one (1) minute. This soft-close process will continue until no additional bids are received during the final minute. All winning bids are binding and subject to the applicable buyer's premium and these Terms & Conditions. ALL SALES ARE FINAL: All sales are final. No returns or exchanges will be accepted. Once bidding has closed and the winning bid has been confirmed, the successful bidder enters into a legally binding purchase agreement and is obligated to complete the transaction in accordance with these Terms & Conditions. Legal ownership and possession of the vehicle will transfer only upon completion of all applicable payment, title transfer, and release requirements. Bids cannot be changed, canceled, or withdrawn once submitted, except as required by applicable law. NO WARRANTIES: All items are sold as is, where is without warranties or guarantees, expressed or implied as to the quality, character or condition. The motor vehicles described herein are sold by the estate on an 'AS-IS, WHERE-IS' basis with all faults. The Estate, Executor, Administrator, and Auctioneer make no warranties, express or implied, including but not limited to any warranty of merchantability or fitness for a particular purpose. The Buyer accepts full responsibility for any and all mechanical, structural, electrical, or cosmetic defects, known or unknown. All sales are final. INSPECTION: Buyers are responsible for evaluating the condition of each vehicle prior to bidding. Photographs, videos, and descriptions are provided to assist buyers in making informed purchasing decisions and are an important part of each listing. In-person inspections may be offered at the Auctioneer's discretion but are not guaranteed. Buyers acknowledge that they may be required to make their purchasing decisions based solely on the photographs, videos, and information provided. By placing a bid, buyers acknowledge that they have had the opportunity to review the available information and accept responsibility for their purchasing decisions. Failure to inspect a vehicle in person does not relieve the buyer of their obligations under these Terms & Conditions. SETTLEMENT: Successful bidders will be invoiced in U.S. dollars. A $1,000.00 deposit per vehicle will be charged to the credit card provided at registration immediately following the close of the auction and applied toward the total purchase price. Buyers agree to provide valid credit card information, maintain sufficient funds for the deposit, and pay all charges associated with their winning bids in accordance with these Terms & Conditions. Buyers agree not to initiate fraudulent or unauthorized chargebacks. The remaining balance must be paid by verified cashier's check within forty-eight (48) hours following the close of the auction. Buyers are responsible for all applicable taxes, title fees, registration fees, and other governmental charges associated with transferring and registering their vehicles. Such taxes and fees are not collected by Montrie Auction & Estate Service, LLC and will be handled by the appropriate titling or taxing authority. Vehicle titles will be issued in the name of the registered winning bidder unless alternative arrangements are approved in writing by Montrie Auction & Estate Service, LLC, subject to applicable title requirements. TITLED VEHICLES: The vehicles offered in this auction are part of an estate and are subject to the completion of any required probate court documentation and title transfer procedures. Processing times may vary and are outside the Auctioneer's control. All vehicles must remain at their current location until the necessary documentation has been received and the vehicles are legally eligible for transfer. Buyers will be notified when their vehicles are authorized for release and pickup. VEHICLE PICKUP: Local pickup only. All vehicles are located in Toledo, Ohio, near Holland-Sylvania and Central Ave; address will be provided to successful high bidders.. Vehicles are to remain at their current location until approved probate court transfer paperwork is received and title can be transferred. Pickup is strictly by appointment and will be scheduled only after full payment has been received and the vehicles are authorized for release. Successful bidders will be notified when their vehicles are available for pickup and provided with scheduling instructions. Buyers are responsible for arranging and paying for any necessary transportation, towing, or removal services. Buyers must arrange pickup within three (3) business days following notification that their vehicle is available for release, unless otherwise agreed upon in writing by Montrie Auction & Estate Service, LLC. INJURY & DAMAGE: All bidders, buyers, and their agents enter the auction premises and participate in vehicle inspections, pickup, and removal activities at their own risk. Buyers are responsible for any personal injury or property damage caused by themselves or their agents while on the premises, including damage occurring during vehicle removal. Buyers agree to indemnify and hold harmless Montrie Auction & Estate Service, LLC, the Seller, and their respective representatives from claims, damages, losses, or expenses arising from the negligent or wrongful acts of the buyer or their agents, to the extent permitted by law. Buyers are responsible for the reasonable costs of repairing property damage they or their agents cause. Such costs may be charged to the credit card provided at registration only as authorized by the buyer and permitted by applicable law. Professional transportation or towing services are recommended when necessary. CONSENT TO CONTACT: By registering for or participating in this auction, bidders authorize Montrie Auction & Estate Service, LLC, its staff, agents, and authorized scheduling partners to contact them regarding auction-related matters, including bidding, payment, title documentation, and vehicle pickup. Communications may be made using the contact information provided during registration, including telephone calls, text messages, and emails, subject to applicable law. CHANGE WITHOUT NOTICE: Montrie Auction & Estate Service, LLC reserves the right to modify or cancel auction lots, extend bidding periods, or change auction closing dates and times when necessary. In the event of technical difficulties, internet outages, bidding platform malfunctions, or other unforeseen circumstances, Auctioneer reserves the right to extend, reopen, postpone, or cancel affected bidding or auction lots. Reasonable efforts will be made to notify registered bidders of material changes when practicable. CLAIMS: Any disputes, controversies, or claims arising out of or relating to this auction or these Terms & Conditions shall be governed by the laws of the State of Ohio.
