Auction #60910T Terms & Conditions All items in this auction are sold "AS-IS" All Bidders in this auction acknowledge that they have read and accepted the General Terms and Conditions provided in the Yellow Tag Auctions User Agreement as posted on the Registration Page. All terms, conditions, explanations and information are intended to be supplemental and complimentary to each other. They are incorporated by reference into this page, and collectively they govern this auction. All quantities are plus or minus two percent (+/-2%) Inspections: Contact Customer Service for inspection details at (864) 461-2400 or [email protected] Bidders in this auction may be required to provide a deposit at auctioneer's discretion. Invoices will be emailed to successful bidders within 24 hours of auction close. Payment in full is due no later than 12:00 Noon ET on Tuesday September 15, 2026 Buyers who do not make payment in full by Payment Deadline will be charged an additional 2% of their invoice total or $50 whichever is greater. The Removal Deadline for all items in this auction is Thursday September 17, 2026 Any extensions to the Removal Deadline must be approved in writing by Yellow Tag Auctions. Buyers who do not remove their items completely by Removal Deadline will be charged storage of $50 per lot per day. Items which are not picked up after 10 days of storage will be considered abandoned and Buyer's items will be subject to sale in order to repay storage charges. Bidding for items will begin to close at 11:00 AM ET on Thursday September 10, 2026. The items will close in the order listed on the website. This Auction will feature automatic bid extension, which will grant a four (4) minute extension to the end of the auction of any item receiving a bid during the last four (4) minutes. The item will close when four (4) minutes have elapsed without any bidding activity. All internet bids are treated as if they were given at a live auction. All Bidders will be held accountable for their internet bids. Your internet bids are a contract and you are responsible for honoring them. Buyer's Premium: An eighteen percent (18%) buyer's premium will be added to all winning bids, resulting in the total purchase price. Acceptable Forms of Payment are dependent on your bid total: Bid Total Under $1500.00: Acceptable forms of payment are Credit Card, Money Order, or Certified Check. Bid Total Equal To or Greater Than $1500.00: Acceptable forms of payment are Wire Transfer, Money Order, or Certified Check. All lots in this auction carry a $5 LOT LOADING FEE, see specific lots for details. Yellow Tag Auctions will ONLY load on to APPROPRIATE Trailers. Buyer must also pay all sales, export, use and other taxes due to any federal, state or local taxing authority as a result of Buyer's purchase, including without limitation, any taxes arising from any Buyer's Premium. To receive the benefit of any tax exemption, Buyer must supply Yellow Tag Auctions, LLC with a sales tax exemption certificate. Exemption forms are auction specific and will need to be completed for every event. Internet Bidding This is an Internet-only Auction, which means the highest bid online when the bidding closes on a particular item will be the winning bid for that item. They are incorporated by reference into this page, and collectively they govern this auction. Buyer is required to remove all items in the lots purchase by the removal deadline. If the buyer does not remove an item within the stated removal period, Yellow Tag Auctions, LLC and the Seller may, at their sole discretion, deem the Asset to have been abandoned by the Buyer and the Buyer will have no further rights with respect to the Asset. Buyers, outside contractors, including riggers and machinery movers, will not be allowed to work on the Seller's premises. Unclaimed items are subject to additional fees and may be disposed of. Items not picked up by removal deadline will be considered abandoned. Abandoned items will be subject to a $50 per lot/per day storage fee and may be disposed of if remaining on site after the removal deadline. Buyers are strictly forbidden to send any third party customers onto property for the sole purpose of inspection of items for possible resale. Yellow Tag Auctions, LLC and the Seller want all of our buyers to feel they have been treated fairly and pay a fair price for the items based on their condition. Please do not enter a bid at a price that is greater than you are comfortable paying for any individual item based on its condition. There will be no adjustments to the final bid price after the bidding closes. Yellow Tag Auctions, LLC reserves the right to remove any item from the auction prior to invoices being generated. If for any reason Yellow Tag Auctions, LLC is unable to deliver any Goods purchased by Buyer, Yellow Tag Auction's sole liability shall be to return all sums paid by Buyer to Yellow Tag Auctions in respect of such Goods. If a technology malfunction, such as a localized internet outage, materially affects the outcome of a Selling Event, YTA reserves the right to withdraw or adjust the auction within 72 hours following the original Selling Event close time. In the event of a loss of the Goods prior to when risk of loss passes to a buyer, SELLER’S SOLE LIABILITY TO BUYER FOR SUCH LOSS SHALL BE TO RETURN BUYERS PAYMENTS TO THE EXCLUSION OF ALL OTHER REMEDIES. IN NO EVENT SHALL SELLER BE LIABLE TO BUYER FOR ANY OTHER DAMAGES INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, STATUTORY, PUNITIVE OR EXEMPLARY DAMAGES, LOSS OF PROPERTY, PERSONAL INJURY, AND LOSS OF PROFIT OR OTHER ECONOMIC LOSS, REGARDLESS OF THE NATURE OF THE CLAIM OR THEORY OF RECOVERY. Neither Yellow Tag Auctions, LLC nor the Sellers makes any warranties or representations of any kind of nature with respect to the property or its value, and in no event shall they be responsible for correctness of description, genuineness, attribution, provenance, authenticity, authorship, completeness, condition of the property or estimate of its value. No statement (oral or written) in the catalog, during inspection, or elsewhere shall be deemed such a warranty or representation, or any assumption of responsibility. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, THE WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE AND MERCHANTABILITY ARE EXPRESSLY DISCLAIMED. THE GOODS ARE BEING SOLD “AS IS” AND “WHERE IS.” Seller represents and warrants only that (i) Seller has the legal right to sell the Goods; and (ii) the Goods are free and clear of all mortgages, liens, pledges, security interests, taxes, charges, claims, restrictions and other encumbrances.
